Definitions

 

  • “Jobseeker” or “Candidate” means a person who is looking for a job
  • “Employer” means a person or organisation that employs people
  • “Recruiter” means recruitment agency or employment agency, a business that finds workers for other companies and organisations
  • “Services” means products and services made available by us through the Website
  • “Order Form” means a formal order for Services using a form provided by Stop the Commute and signed by Customer
  • “Customer” means a company, organisation or a person that buys or uses Services from Stop the Commute
  • “Rate Card” means standard pricing for Services provided by Stop the Commute
  • “Contract Month” means the Calendar Month beginning on the start date as specified by the Customer on the Order Form
  • “Calendar Month” means a period from a specified day in one month to the day numerically corresponding to that day in the following month, less one. For example, Calendar Month starting on 10th December ends on 9th January
  • “Contract Term” means the full period of time as stated on the Order Form

 

License to use Website

 

Unless otherwise stated, Stop the Commute and/or its licensors own the intellectual property rights in the Website and material on the Website.  Subject to the license below, all these intellectual property rights are reserved.

 

You may view, download for caching purposes only, and print pages or any other content from the Website for your own personal use, subject to the restrictions set out below and elsewhere in these terms and conditions.

Jobseekers, Employers and Recruiters must accept that nothing on this Website constitutes, or is meant to constitute, advice of any kind. If you do not agree, please do not use this Website.

 

Jobseekers, Employers and Recruiters must accept that the Website operates as a venue only. We do not:

 

  • supply Jobseekers or introduce Jobseekers to Employers or Recruiters or vice versa
  • check or confirm the identity of Jobseekers or Employers or Recruiters
  • check or confirm Jobseekers’ legal eligibility to work in the United Kingdom or elsewhere
  • check or confirm Employers’ or Recruiters’ legal eligibility to employ or recruit Jobseekers or workers
  • check or confirm Jobseekers’ authorisation, qualifications, experience or skills to undertake the jobs that Employers or Recruiters may be seeking to fill
  • check or confirm Jobseekers’ suitability or unsuitability for jobs that Employers or Recruiters may be seeking to fill
  • take up, check or confirm any references in relation to Jobseekers.

This could happen when (for example, you apply for a job with an Employer, its representative or a Recruiter) a job is based outside the EEA. Stop the Commute will not be liable to you (whether in contract, tort or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this Website:

  • for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.

 

Stop the Commute is not liable for any losses that are not foreseeable or likely consequence of your use of the Website or a breach by us of these terms and conditions.

 

Stop the Commute is not liable for any dealings you have with third parties including, without limitation, with other users of the Website or Employers or Recruiters or advertisers on this Website or accessed via links on this Website

 

These limitations of liability apply even if Stop the Commute has been expressly advised of the potential loss.

 

Exceptions

 

Nothing in this Website disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in this website disclaimer will exclude or limit Stop the Commute’s liability in respect of any:

Breaches of these terms and conditions

 

Without prejudice to Stop the Commute's other rights under these terms and conditions, if you breach these terms and conditions in any way, Stop the Commute may take such action as Stop the Commute deems appropriate to deal with the breach, including suspending your access to the Website, prohibiting you from accessing the Website, blocking computers using your IP address from accessing the Website, contacting your internet service provider to request that they block your access to the Website and/or bringing court proceedings against you.

 

Variation

 

Stop the Commute may revise these terms and conditions from time-to-time.  Revised terms and conditions will apply to the use of this Website from the date of the publication of the revised terms and conditions on this Website. You will be deemed to accept the terms and conditions when you next use the Website following any revision to the terms and conditions. Assignment

 

Stop the Commute may transfer, sub-contract or otherwise deal with Stop the Commute's rights and/or obligations under these terms and conditions without notifying you or obtaining your consent.

 

You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.  

 

Severability

 

If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.  If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

 

Entire agreement

 

These terms and conditions constitute the entire agreement between you and Stop the Commute in relation to your use of this Website, and supersede all previous agreements in respect of your use of this Website.

 

Law and jurisdiction

 

These terms are governed by the law of England and are subject to the exclusive jurisdiction of the Courts of England.

 

Cost to Jobseekers

 

Jobseeking services on Stop the Commute are FREE to use for all Jobseekers.

 

Jobseeker CVs and profiles

 

Stop the Commute does not review or monitor any information or content created, uploaded or provided by Jobseekers including CVs, profiles, photos, video content and any links to other content or websites. Stop the Commute does not accept any responsibility or liability for the contents of Jobseekers’ CVs, profiles, video content or photos or any other content or website that Jobseekers may link to.

 

Job advertisements and Employer profiles

 

Stop the Commute does not review or monitor any information or content created, uploaded or provided by Employers or Recruiters including job advertisements, Employer or Recruiter profiles, photos, video content and any links to other content or websites. Stop the Commute does not accept any responsibility or liability for the contents of Employers’ or Recruiters’ job advertisements, Employer or Recruiter profiles, video content or photos or any other content or website that Employers or Recruiters may link to.

 

For Employers and Recruiters

 

In addition to the terms and conditions detailed above, the following also apply to Employers and Recruiters.

 

Customer’s name, logos and trademarks

 

As part of our Services such as but not limited to job advertising and company profile, the Website shows Customer’s name, logo and trademarks. Customer consents to this.

 

We may also use Customer as a case study or a reference in our marketing materials that may include, without limitation, adverts, brochures, websites and our social media channels. Customer consents to this.

 

Customer’s profile on Stop the Commute

 

A core part of the Services we offer to Customer is to allow the Customer to create their business or company profile on the Website. Customer’s business or company profile may include information or content, without limitation, business or company name, logos, trademarks, text, documents, audio material, audio-visual material, videos, images, advertisements, links to third party content and websites and job vacancies. Customer must only create business or company profile on the Website and upload, submit or enter information or content that Customer is legally authorised to do.

 

Additionally, information or content uploaded, entered or submitted by you to the Website must not:

 

  • be illegal, unlawful, abusive, threatening, discriminatory, defamatory, obscene, offensive, misleading, false, blasphemous, pornographic
  • encourage or incite violence or religious or racial hatred
  • infringe any third party's legal rights
  • breach any applicable legislation, regulation, copyright, trade mark or intellectual property rights of anyone in any jurisdiction
  • be capable of giving rise to legal action whether against you or Stop the Commute or a third party (in each case under any applicable law).

Job advertising

 

Stop the Commute aims to help Jobseekers find Employers or Recruiters and jobs in the Home Counties. When Jobseekers search for Employers or Recruiters or jobs on the Website, they expect to find accurate results to their search. This means users of the Website expect to find real, legitimate Employers or Recruiters advertising real and legitimate jobs. Stop the Commute will, at our discretion and without any liability to Customer, remove any business or company profiles and job adverts that are in breach of these rules.

 

Customer agrees:

 

  • to place job adverts on the Website that are for genuine vacancies only and not for anything else
  • that their job adverts are legally compliant with the relevant recruitment and employment law and do not discriminate on the grounds of disability, race or sex or any other aspect with respect to the relevant recruitment and employment law. (It is the Customer’s duty to understand their legal obligations with respect to recruitment and employment law or any other law that may apply to them.)
  • to not place duplicate job adverts
  • to not use links (URLs or email links) in any format within the body copy of the job advert. (Applications received through the Apply Now button will be emailed to Customer’s registered email address used when Customer registers on the Website.)
  • to not use keywords in an inappropriate way within the body of the job advert or the job title in order to try to influence the position as a result of Jobseekers’ search. By inappropriate, we mean excessive repetition of keywords or misleading use of keywords within the job title of body copy of job advert or any other part of the job advert.

 

If Stop the Commute considers a job advert to be discriminatory or if we regard it to be in breach of our rules as outlined above and throughout these terms and conditions, we may at our sole discretion remove it from the Website without any liability to Customer for any refund of amount paid to Stop the Commute.

 

Job adverts go live after Stop the Commute confirms payment from Customer.

 

Response to job advertisements

 

Stop the Commute does not guarantee that Customer will get any response to Customer’s job advertisements. Where there are responses, we do not guarantee or recommend a Jobseeker’s suitability or unsuitability or their eligibility to take up the job you are may be seeking to fill.

 

You agree not to discriminate on any grounds against Jobseekers that respond to your job advertisements. You agree to deal with Jobseekers responding to your job advertisements in a fair and professional manner and not deal with respondents in any way that may bring Stop the Commute into disrepute.

 

You agree to indemnify Stop the Commute against any action or claim brought by anyone against Stop the Commute arising from your breach of these terms and conditions.

 

CV database

 

Jobseekers that register on Stop the Commute or upload their CV to the Website or apply for jobs advertised on the Website, can choose to make their personal details including their CV available to be viewed or downloaded by Employers and Recruiters who buy the relevant CV database related Services from Stop the Commute.

 

All rights including copyright and intellectual property rights in the CV database or its content remain with Stop the Commute and are not transferred to the Customer. By continuing to use the Website and CV database you agree to this and these terms and conditions.

 

Customer’s access to the CV database depends on the Services bought from Stop the Commute. Once you have bought a relevant CV database Service, you agree to:

 

  • use the CV database Service for the sole purpose of finding relevant Jobseekers for specific vacancies that you may have as an Employer or use the CV database Service for the sole purpose of finding relevant Jobseekers for specific vacancies that you may have on behalf of your client if you are a Recruiter
  • use the CV database to search and download details of Jobseekers including theirs CVs using only the tools provided on the Website
  • contact Jobseekers using their contact details on the CV database for the sole purpose of introducing or discussing specific job vacancies that you may have if you are an Employer or contact Jobseekers using their contact details on the CV database for the sole purpose introducing or discussing specific job vacancies that your client may have if you are a Recruiter
  • use CV database and its content for the sole purpose of finding Jobseekers for specific vacancies and not use it to promote, introduce or discuss with Jobseekers any other products or services

 

You also agree not to discriminate on any grounds against Jobseekers that you contact through the CV database. You agree to deal with these Jobseekers in a fair and professional manner and not deal with these Jobseekers in any way that may bring Stop the Commute into disrepute.

 

You agree to indemnify Stop the Commute against any action or claim brought by anyone against Stop the Commute arising from your breach of these terms and conditions.

 

You agree not to sell, supply, license or in any other make available CV database or any parts of its contents to another other person, company, organisation including another member of your group of companies.

 

Stop the Commute does not review or monitor for viruses in any information or content created, uploaded or provided by Jobseekers including but not limited to, their CV, profiles, photos, video content and any links to other content or websites. Stop the Commute does not accept any responsibility or liability for the information or content created, uploaded or provided by Jobseekers including their CV, profiles, photos, video content and any links to other content or websites that Jobseeker may link to.

 

Use of username and password

 

When registering on the Website, you will choose a username and password of your choosing. You will be responsible for all actions taken using that username and password. You agree to only use the Website using your own username and password. You must ensure that the username and password are kept confidential. 

 

Stop the Commute may disable your username and password at Stop the Commute’s sole discretion without notice or explanation if we believe that our Services are being used by an unauthorised person or these terms and conditions are being breached.

 

Pricing and payment terms

 

Our prices are detailed on the Rate Card and are exclusive of VAT. All prices are guaranteed for the Contract Term as agreed with the Customer on the Order Form.

 

Customer agrees to keep confidential any discounts agreed with Stop the Commute.

 

Termination

 

Contract expires at the end of the Contract Term.

 

Contract expires in the event that Stop the Commute becomes insolvent, ceases to trade or goes into liquidation or Stop the Commute is in breach of these terms and conditions and fails to resolve the breach within 14 days of being notified of the breach by Customer.

 

Where Customer wishes to terminate a contract before the end of the Contract Term, Customer must do so in writing.

 

When terminating a contract before the end of the Contract Term, Customer must serve the following notice:

 

  • where the Contract Term is up to three months, 30 days’ notice is required
  • where the Contract Term is more than three months and less than six months, 90 days’ notice is required
  • where the Contract Term is six months or more, 180 days’ notice is required

 

Where Customer terminates a contract before the end of the Contract Term, this will result in the loss of any agreed discounts for the full Contract Term. Any refund will be calculated based on unused portion of the contracted Services less any agreed discounts for the full Contract Term.

 

Stop the Commute may stop all Services to Customer if Customer becomes insolvent, ceases to trade or goes into liquidation.

 

Stop the Commute may stop all Services to Customer if Customer is in breach of these terms and conditions and fails to resolve the breach within 14 days of being notified of the breach by us.
